TN Visa: What It Means for Your Law Firm

A TN visa is a nonimmigrant work status created under the USMCA (formerly NAFTA) that allows citizens of Canada and Mexico to work in the United States in one of a defined list of professional occupations — engineers, accountants, scientists, management consultants, and dozens more. There is no annual cap and no lottery. Status is granted in increments of up to three years and can be renewed indefinitely, as long as the professional keeps qualifying and maintains nonimmigrant intent.

The process is unusually direct. Canadian citizens can apply in person at a port of entry or airport preclearance with an employer support letter and credentials in hand, often receiving a decision the same day. Mexican citizens apply for a TN visa at a US consulate before traveling. Either way, the core of the case is proving that the offered role fits a USMCA profession and that the candidate holds the required degree or license.

What does the TN visa mean for your firm’s operations?

For an employment-based immigration practice, TN cases are the fastest, leanest matters on the menu — and that changes how you should staff, price, and schedule them. There is no cap registration and no prevailing wage step, and border applications skip the petition filing entirely: a well-run TN can go from case opening to work authorization in days, not months.

That speed cuts both ways operationally. Flat fees for TN work are typically modest compared to H-1B, so profitability depends on volume and efficiency: templated support letters, a tight case onboarding checklist that verifies citizenship, degree equivalency, and profession match up front, and paralegals who can turn a complete file quickly. Clients often call with a start date a week out, so your workflow needs a genuine rush lane.

TNs also generate recurring revenue. Renewals every three years — plus dependents and employer changes in between — reward a firm with reliable docketing and reminder systems. And because TN is not a dual-intent status, every TN client is a future conversation about PERM and an employment-based green card, if sequenced carefully. Firms that treat TN work as a pipeline, not a one-off, build durable corporate relationships from it.

If your team lacks bandwidth for quick-turn TN filings, Valero Legal’s contract business immigration paralegals can prepare them under your attorneys’ direction — keeping the speed without adding headcount.
