E-2 Visa: What It Means for Your Law Firm

An E-2 visa is a nonimmigrant treaty-investor visa that allows a citizen of a country holding a qualifying treaty with the United States to live and work in the US to develop and direct a business in which they have invested a substantial amount of capital. There is no fixed minimum investment in the law: the investment must be substantial relative to the cost of the business, and the enterprise must be more than marginal — capable of generating more than a living for the investor alone.

E-2 status also covers key employees of the enterprise — executives, supervisors, and workers with essential skills — as long as they share the investor’s treaty nationality. Status is granted in renewable increments and can be extended indefinitely while the business remains real and operating, though the E-2 itself is not a path to a green card. Spouses of E-2 holders are generally authorized to work.

What does the E-2 visa mean for your firm’s operations?

E-2 cases are among the most evidence-heavy nonimmigrant matters an employment-based immigration practice can take on, and they should be scoped, priced, and staffed accordingly. The file is less about forms and more about the business: tracing the lawful source and path of funds, documenting that capital is genuinely at risk, and presenting a credible business plan with financial projections.

The staffing implication is direct: your paralegals need to be comfortable with corporate records, bank statements, leases, and financial statements — not just immigration forms. Timelines are driven largely by consular appointment availability and each consulate’s company-registration practices, so client expectations need managing from the first call.

On billing, the document depth is exactly why E-2 work supports premium flat fees — but only if you scope clearly. Decide up front whether the business plan is drafted in-house, by the client, or by a referred specialist, because that single decision swings your hours dramatically.

E-2s are also relationship engines. One approved investor can generate renewals, employee E-2 cases, dependents, and years of follow-on corporate work. The operational failure point is almost always document collection: without a structured, checklist-driven case onboarding system, these cases stall for months. Valero Legal helps firms build those systems — and its contract paralegal team can assemble E-2 files when your own staff is at capacity.
